Dickinson Wright Appellate Practice Receives Win in the U.S. Court of Appeals for the Ninth Circuit

Dickinson Wright PLLC is pleased to announce that the firm’s Appellate Practice successfully argued a case in front of the U.S. Court of Appeals for the Ninth Circuit. In United States of America v. LeCharles Baldon, the Ninth Circuit reversed the District Court’s decision on a sentencing issue in a criminal case.

Attorney Justin Bustos (Member, Reno) represented the defendant in the case that dealt with the District Court’s application of the federal sentencing guidelines. In a published Opinion, the Ninth Circuit ruled that the case be remanded for resentencing. Dickinson Wright argued that the District Court erred in finding that the client’s prior convictions under section 215 of the California Penal Code qualify as crimes of violence under U.S.S.G. § 4A1.1(e). “We are pleased that the Ninth Circuit has overturned part of the District Court’s decision after hearing arguments on the case. Our appellate team worked diligently to develop a successful argument and strategy to address our client’s concerns,” says Justin.
