    Overview

    Tracy Bergeron Lucha represents employers in respect of workplace safety and insurance, human rights, and other employment and labour law matters including pay equity, health and safety, alleged employment standards breaches and labour disputes.

    Tracy’s combined educational and professional experience uniquely enable her to comprehensively advocate on behalf of employers in respect of employees with complex disability issues.

    Tracy has offices in both Windsor and Toronto.

    Experience

    • Representing employers in matters at various boards and tribunals in Ontario including the Workplace Safety and Insurance Board, Workplace Safety and Insurance Appeals Tribunal, Ontario Labour Relations Board and the Human Rights Tribunal of Ontario.
    • Extensive experience providing advice to foreign and domestic employers of all types in a full spectrum of workplace safety and insurance matters including registration, entitlement objections and appeals, reconsideration requests, return to work and work reintegration, transfer of costs and SIEF submissions.
    • Providing workplace safety and insurance training for supervisors, human resources professionals and management.
    • Advising all sizes of employers in respect of recruiting, hiring and terminating employees and obligations in connection with the sale of a business.
    • Assisting employers with drafting agreements including employment, confidentiality, non-disclosure, non-solicitation and non-competition agreements, as well as structuring settlements and drafting releases.
    • Routinely advising employers regarding day-to-day workplace and legislative concerns.
    • Providing critical document review and recommendations along with assisting in the development of employer literature including policies and handbooks.
    • Labour practice including representation in grievances and arbitrations.
    • Assisting employers with pay equity job valuations, analyses, and reviews, responding to complaints and pay equity officers.
    • Canadian employment law seminars for cross-border clients.
    • Specializing in representing large and mid-size automotive sector clients in all manner of workplace safety and insurance matters, all sizes of industrial, construction, manufacturing employers, as well as other Schedule 1 and Schedule 2 employers, in workplace safety and insurance matters.
