Heather Frayre was recently quoted in a Bloomberg Law article, “Employers Avoid Knee-Jerk Reactions to Green Card Sponsor Bans.” The article discusses employers’ reactions to the U.S. Department of Labor’s (DOL) announcement suspending Microsoft Corp. and other tech companies from the PERM labor certification program in connection with ongoing investigations. Although DOL has pursued similar investigations and settlement agreements with employers for several years, Heather said, “The reality, though, is that this action is going to have its intended effect, which is to make employers think twice about hiring and sponsoring foreign workers.” She notes that the effect is likely to be compounded by other measures across various programs that add fees, procedural hurdles, or compliance risks for employers.
