“With non-competes under attack, courts have significant discretion as to whether and how they are enforced. There is plenty of room within the existing legal framework for exercise of discretion by courts, and other states have vibrant and markedly different bodies of case law on various aspects of non-competes (not just the two topics addressed here). As society’s view of non-competes evolves, will the courts’ evolve with it?” writes Mr. Quick and Ms. Pellegrino.
