    Elizabeth L. Luckenbach was recently quoted in the Michigan Lawyers Weekly article “Expensive, time-consuming catastrophe.” The Michigan Court of Appeals has held that default judgment was properly levied as a discovery sanction in the case of siblings’ conflict over their late father’s trust. “After more than three years of litigation in the probate court that were bogged down by what the probate court characterized as ‘willful and intentional’ discovery abuses by respondent, the Court of Appeals affirmed the ability of our trial courts to impose the harshest of penalties — a default judgment — against litigants who play ‘fast and loose’ with discovery obligations…,” Elizabeth said.
